These terms of use (together with the documents referred to in them) set out the terms of use on which you may make use of our website www.catersnews.com (our “site”), whether as a guest or a registered user. If you wish to upload any photographs and/or video content (User Content) to, or download User Content from, our site, you will be required to set up an account with us, which is subject to additional terms and conditions. Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our site.

Access to our site

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Content Standards

Content on our site must not contain imagery or audio content which:
(a) is sexually explicit or suggestive, violent, profane or pornographic, contains nudity, or promotes the excessive or irresponsible consumption of alcohol;
(b) promotes illegal use of alcohol, drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous or any particular political agenda or message;
(c) is obscene or offensive, derogatory of any ethnic, racial, gender, religious, professional or age group, endorses any form of hate or hate group or contains any other material that is threatening, hateful, discriminatory or that could encourage the commission of a criminal offence;
(d) is defamatory or libellous;
(e) contains any trade marks, logos or trade dress owned by third parties, or advertises or promotes any brand or product of any third party, without permission, or contains any personal identification, such as licence plate numbers, personal names, email addresses or street addresses;
(f) contains software viruses or files designed to damage or disrupt the good working order of any computer or telecommunications equipment;
(g) contains any material which infringes the copyright or other intellectual property rights, or other proprietary rights or privacy rights of a third party or which breaches the confidentiality of a third party; or
(h) contains any other material which is considered to be inappropriate,
paragraphs (a) to (h) inclusive shall together be referred to as Inappropriate Content.
We will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity of or to locate anyone posting any Inappropriate Content or other similar material onto our site.

Reporting inappropriate or unlawful content

If you consider any of the Content on our site to contain any content which does not comply with the content standards set out above, please notify us of such Content by:

If you are an intellectual property rights owner and consider that any Content infringes your intellectual property rights, you may notify us of the alleged infringement by sending the following information to us:

(a) identification of the work which you claim to be infringed;
(b) identification of the Content which you claim to infringe that work in order to allow us to locate the allegedly infringing material;

Our liability

This site and the Content and any other information contained on it are provided “as is” without any representation or endorsement made and without warranty of any kind whether express or implied. We do not endorse any User Content and we expressly disclaim any and all liability in connection with any User Content.
We do not represent or warrant that any User Content on our site does not infringe the intellectual property rights or other proprietary or privacy rights of a third party.

To the extent permitted by law, we hereby expressly exclude any liability for:
(a) any loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site;
(b) User Content which infringes intellectual property or other proprietary or privacy rights of a third party; and
(c) any websites linked to our site and any materials posted on it.

We shall not in any circumstances be liable to you for any of the types of loss listed below whether arising from negligence, breach of contract or otherwise.

Those types of loss are as follows:

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

Suspension and termination

We will determine, in our discretion, whether there has been a breach of these terms of use through your use of our site. When a breach of these terms of use has occurred, we may take such action as we deem appropriate.

Failure to comply with these terms of use may result in our taking all or any of the following actions:

(a) immediate, temporary or permanent withdrawal of your right to use our site;
(b) immediate, temporary or permanent removal of any posting or material uploaded by you to our site;
(c) issue of a warning to you;
(d) legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from your breach of these terms of use;
(e) further legal action against you;
(f) disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
We exclude liability for actions taken in response to breaches of these terms of use. The responses described in these terms of use are not limited, and we may take any other action we reasonably deem appropriate.

Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
